Jersey Trademark Reform: Transition to an Independent Registration System

As of 1 August 2026, Jersey has launched its own independent trade mark registration system, moving away from its long-standing reliance on UK trade mark rights and establishing its own register, examination procedures and opposition process.

How did the previous system work?

Until now, trade mark protection in Jersey was secured either by extending a UK registration to cover Jersey, or automatically through international registrations designating the UK. There was no standalone Jersey registration route.

What does the new system introduce?

  • Applications can now be filed directly in Jersey, with no requirement for a corresponding UK registration.
  • Jersey operates its own register, examination process and opposition procedure.
  • Jersey is now available as a separate designation under the Madrid Protocol; designating the UK alone will no longer automatically extend protection to Jersey.
  • Renewal fees for Jersey and UK rights will be payable separately.

Do existing rights holders need to act?

No. Transitional provisions are in place to preserve existing rights. Jersey rights derived from UK registrations will be carried over automatically to the new register, and international registrations currently covering Jersey through a UK designation will continue to enjoy protection during the transitional period. No action is required from existing rights holders at this stage.

What changes going forward?

From 1 August 2026, a UK trade mark registration will no longer automatically extend protection to Jersey. Businesses seeking protection there will need to either file a direct application in Jersey or designate Jersey separately through the Madrid System, each subject to its own official fees.

It is also worth noting that, as clarified by the Jersey authorities in 2024, EU trade marks (EUTMs) do not cover Jersey — and in fact have not done so since April 2009.
